2. Use of the Website
– The User must be over 18 years old to access the services.
– The User agrees to use this website only for lawful and legitimate purposes.
– Improper, fraudulent, or harmful use may result in legal claims and blocked access.
3. Madrid New Start Services
Madrid New Start provides diverse services in the real estate and cultural sectors, including:
– Advisory and assistance in real estate purchase and rental transactions.
– Personalized property search services (optional).
– Management and distribution of cultural products, artworks, clothing, and accessories marketed on the website.
– Editorial content through the Discover Madrid blog.
4. Real Estate Transactions
Madrid New Start provides advisory and support services in real estate purchase and rental transactions. In all cases, applicable fees will be communicated to the Client in advance and formalized through the issuance of the corresponding invoice.
4.1. Purchase Transactions
– Madrid New Start may assist in property purchase transactions, either through properties directly marketed in its portfolio or via a personalized property search service for buyers.
– Madrid New Start does not guarantee future profitability, property appreciation, or any circumstances beyond its control.
4.1.1. Properties Marketed Directly by Madrid New Start
– When the property is marketed directly by Madrid New Start, brokerage fees are fully covered by the seller.
– In this case, the buyer does not pay any commission to Madrid New Start.
4.1.2. External Property Search Service
– Madrid New Start provides an advisory service for buyers interested in locating properties outside its own portfolio, accessing the general real estate market.
– The purpose of this service is to identify, within the Client’s budget, the most suitable investment opportunities and assist in the selection process.
– Applicable fees will be communicated to the Client in advance and invoiced to the buyer upon completion of the purchase.
4.2. Rental Transactions
– Madrid New Start provides services related to short, medium, and long-term rental agreements.
4.2.1. Long-Term Rentals (Primary Residence)
– For properties directly marketed by Madrid New Start, brokerage fees are fully covered by the landlord.
– The tenant does not bear any commission related to brokerage or lease formalization, in compliance with Law 12/2023, of May 24, on the right to housing.
4.2.2. Advisory Services in Rental Searches
– By using the Madrid New Start portal, the User understands and accepts that they are not contracting relocation or rehousing services.
– Madrid New Start does not act as a relocation company but as an independent advisor providing support throughout the rental property search process.
– These services may include, among others:
• Identification and pre-selection of properties suited to the Client’s profile and budget.
• Scheduling and, where applicable, accompaniment to viewings.
• Guidance for presenting the Client’s profile to landlords, subject to submission of required documentation (pay slips, employment contracts, bank certificates, etc.).
• Preparation of reports with relevant information on the properties presented.
• Facilitating contact with external collaborators (moving services, utilities, insurance, etc.).
– In accordance with Law 12/2023, these services do not constitute real estate brokerage nor the formalization of lease agreements, the cost of which is borne exclusively by the landlord.
– They are advisory services provided independently to the tenant, which may entail specific fees that will be communicated to the Client in advance.
– Such fees will become due after the signing of the lease agreement, and payment must be made no later than the day of key delivery, against the invoice issued by Madrid New Start.
6. Sale of Cultural Products, Artworks, Clothing, and Accessories
– Each product will include its specifications.
– Returns: only accepted in cases of damage or conditions different from those advertised.
– Customers must record/photograph the unboxing process.
– Production and shipping are handled by external collaborators.
7. Discover Madrid (Blog)
Editorial space with news, interviews, and recommendations.
Madrid New Start is not responsible for errors or for issues arising from third-party services mentioned.
8. External Collaborators
Madrid New Start works with selected external collaborators but is not responsible for their performance, as they act independently.
9. Intellectual Property
All content is owned by Madrid New Start or its collaborators. Reproduction without authorization is prohibited.
10. Data Protection
The processing of personal data is regulated by the Privacy Policy available at: https://madridnewstart.com/privacy-policy/, which is accepted when contracting our services.
11. Limitation of Liability
Madrid New Start is not responsible for losses, damages, or incidents beyond its control.
12. Indemnity
The User agrees to indemnify Madrid New Start against claims from third parties for misuse.
13. Force Majeure
Madrid New Start will not be held liable for non-compliance due to force majeure.
14. Changes to Terms
Madrid New Start may amend the Terms without prior notice. Continued use implies acceptance.
15. Governing Law, Jurisdiction, and Language
– Spanish law applies.
– Exclusive jurisdiction: courts of Madrid.
– In case of discrepancies, the Spanish version shall prevail.
