3. Servicios Madrid New Start 

Madrid New Start presta diversos servicios en los sectores inmobiliario y cultural, entre ellos:
- Asesoramiento y asistencia en operaciones de compra y alquiler de inmuebles.
- Servicios personalizados de búsqueda de propiedades (opcional).
- Gestión y distribución de productos culturales, obras de arte, ropa y accesorios comercializados en el sitio web.
- Contenido editorial a través del blog Descubre Madrid.

4. Transacciones inmobiliarias

Madrid New Start provides advisory and support services in real estate purchase and rental transactions. In all cases, applicable fees will be communicated to the Client in advance and formalized through the issuance of the corresponding invoice.

4.1. Purchase Transactions

– Madrid New Start may assist in property purchase transactions, either through properties directly marketed in its portfolio or via a personalized property search service for buyers.
– Madrid New Start does not guarantee future profitability, property appreciation, or any circumstances beyond its control.

4.1.1. Properties Marketed Directly by Madrid New Start
– When the property is marketed directly by Madrid New Start, brokerage fees are fully covered by the seller.
– In this case, the buyer does not pay any commission to Madrid New Start.

4.1.2. External Property Search Service
– Madrid New Start provides an advisory service for buyers interested in locating properties outside its own portfolio, accessing the general real estate market.
– The purpose of this service is to identify, within the Client’s budget, the most suitable investment opportunities and assist in the selection process.
– Applicable fees will be communicated to the Client in advance and invoiced to the buyer upon completion of the purchase.

4.2. Rental Transactions

– Madrid New Start provides services related to short, medium, and long-term rental agreements.

4.2.1. Long-Term Rentals (Primary Residence)
– For properties directly marketed by Madrid New Start, brokerage fees are fully covered by the landlord.
– The tenant does not bear any commission related to brokerage or lease formalization, in compliance with Law 12/2023, of May 24, on the right to housing.

4.2.2. Advisory Services in Rental Searches
– By using the Madrid New Start portal, the User understands and accepts that they are not contracting relocation or rehousing services.
– Madrid New Start does not act as a relocation company but as an independent advisor providing support throughout the rental property search process.
– These services may include, among others:
• Identification and pre-selection of properties suited to the Client’s profile and budget.
• Scheduling and, where applicable, accompaniment to viewings.
• Guidance for presenting the Client’s profile to landlords, subject to submission of required documentation (pay slips, employment contracts, bank certificates, etc.).
• Preparation of reports with relevant information on the properties presented.
• Facilitating contact with external collaborators (moving services, utilities, insurance, etc.).

– In accordance with Law 12/2023, these services do not constitute real estate brokerage nor the formalization of lease agreements, the cost of which is borne exclusively by the landlord.
– They are advisory services provided independently to the tenant, which may entail specific fees that will be communicated to the Client in advance.
– Such fees will become due after the signing of the lease agreement, and payment must be made no later than the day of key delivery, against the invoice issued by Madrid New Start.

6. Venta de productos culturales, obras de arte, ropa y accesorios 

- Cada producto incluirá sus especificaciones.
- Devoluciones: sólo se aceptan en caso de daños o condiciones diferentes a las anunciadas.
- Los clientes deben grabar/fotografiar el proceso de desembalaje.
- La producción y el envío corren a cargo de colaboradores externos.

7. Descubre Madrid (Blog)

Espacio editorial con noticias, entrevistas y recomendaciones.
Madrid New Start no se hace responsable de los errores o problemas derivados de los servicios de terceros mencionados.

8. Colaboradores externos

Madrid New Start trabaja con colaboradores externos seleccionados, pero no es responsable de su actuación, ya que actúan de forma independiente.

9. Propiedad intelectual

Todos los contenidos son propiedad de Madrid New Start o de sus colaboradores. Prohibida su reproducción sin autorización.

10. Protección de datos

El tratamiento de los datos personales está regulado por la Política de Privacidad disponible en: https://madridnewstart.com/privacy-policy/, que se acepta al contratar nuestros servicios.

11. Limitación de responsabilidad

Madrid New Start no se hace responsable de pérdidas, daños o incidentes fuera de su control.

12. Indemnización

El Usuario se compromete a indemnizar a Madrid New Start frente a reclamaciones de terceros por uso indebido.

13. Fuerza mayor

Madrid New Start no se hace responsable de los incumplimientos debidos a causas de fuerza mayor.

14. Modificación de las condiciones

Madrid New Start podrá modificar las Condiciones sin previo aviso. El uso continuado implica su aceptación.

15. Ley aplicable, jurisdicción e idioma

- Se aplica la legislación española.
- Competencia exclusiva: tribunales de Madrid.
- En caso de discrepancias, prevalecerá la versión española.
